When you have propspective customers fill out your forms do you have a clause in it saying they are giving you permission to call them?
My husband (almost through his Law degree) and I have had some talks about this lately and it came up at dinner on the weekend with a friend of ours who is a barrister. He recommends putting in a clause. 
I guess it is a good cover if someone changes their mind or decides to get nasty further down the track.
An indemnity clause may save you alot of heartache further down the line.

Excellent point Ladywytch.  I studied law at uni so I put lots of clauses in everything I write LOL - can never be too careful.  I always put something like "Your details will never be given away, or sold.  Please tick the appropriate box:

1. To receive more info about ....

2. I'd like to be kept updated [or receive this information] by ( ) email ( ) post ( ) telephone

etc then as the last one I put

5. I am NOT interested in receiving anymore information regarding XYZ.  If you tick this box your address will be noted merely to ensure you will no longer receive flyers or information from me in relation to XYZ."

 

Another point for ppl to consider is spam emails.  You will notice that when you sign up to a newsletter of some sort from a website or company each and every email will give you information on how to unsubscribe.  I believe (but not 100% certain) that this is in accordance with the law relating to spam.  It doesn't hurt in any case to write at the bottom of your newsletters something like:

 

"If you have received this email in error, or no longer wish to receive my newsletter or product updates, please reply with "UNSUBSCRIBE" in the subject line." This is a good way to keep control of your newsletter contact list and ensure that the people who are receiving it continue to be happy to do so.

Good point with the emails.
It pays to be safe with these things.
The Privacy Act is huge and not everyone can be expected to know it backwards however if we can cover each other here with ideas and tips it is a start.

I only call those who ask to be contacted. as for emails a freind signed me up to a dollar bargain one have tried to unscribe about  6 times or so not happy.
